[+] 23 2024-12-17 RESPONSE by Plaintiff Fear of God, LLC to Order [22]
[+] 24 2024-12-17 SUPPLEMENT to motion for temporary restraining order[14]
[+] 25 2024-12-18 MINUTE entry before the Honorable John J. Tharp, Jr: Upon review of the plaintiff's supplement to its motion for a TRO 23 24, this case is dismissed. The plaintiff acknowledges that the defendants were originally named in case no. 1:24-cv-12057, before Judge Ellis, and it appears the plaintiff amended its complaint in that suit to omit most of the defendants and avoid a joinder ruling the plaintiff anticipated would be unfavorable. That is a form of forum shopping: filing a claim, dismissing that claim in anticipation of an adverse ruling, and then filing a new suit that presents the same claim before a different judge. If the plaintiff wishes to pursue a claim against the defendants named in this case, that claim must be asserted in the case in which it was originally presented. Plaintiff asks the Court, in the alternative, to sever 30 defendants into new cases and for those cases to be reassigned to Judge Ellis. If joinder of all defendants is deemed improper in case no.1:24-cv-12057, the plaintiff may seek severance in that case, though whether to do so is for Judge Ellis to determine. Mailed notice
