MINUTE entry before the Honorable LaShonda A. Hunt: Plaintiff's motion for leave to conduct expedited discovery and electronic service 12 is granted in part and denied in part as follows. Plaintiff may pursue discovery from third-party platforms to obtain reliable contact information for the only remaining Schedule A Defendant. However, any sales and financial data that would arguably go to the question of damages in this case is premature. In addition, because the evidence relating to sales of allegedly infringing products by Defendant is from August 2024 and the listing now appears to have been removed, the Court is not convinced that Plaintiff has shown that electronic service is a reliable method. The Court has modified Plaintiff's proposed order accordingly. Enter Order Authorizing Expedited Discovery. By 4/21/25, Plaintiff must file a status report updating the Court on any subpoena responses received and if a renewed motion for alternative service will be filed. Because Plaintiff is attempting to serve defendants who are purportedly located in a foreign country, the 90-day deadline under Fed. R. Civ. P. 4(m) would not apply. Nevertheless, service must be completed in a reasonable amount of time to keep this case moving forward. Finally, although some of Plaintiff's filings are currently sealed 2, 12, Plaintiff has not filed a motion to seal documents pursuant to L.R. 26.2. Based on the evidence previously submitted by Plaintiff and the admission of liability by virtue of the default, Plaintiff has established that a permanent injunction should be entered. The infringement of Plaintiff's marks irreparably harms Plaintiff and confuses the public. Because this infringement was willful and considering the value of Plaintiff's brand as well as the need to deter infringement that is easily committed and difficult to stop, the Court concludes that $15,000 is an appropriate award of statutory damages against each remaining defendant.
