The Court acknowledges that plaintiff has protectible rights in that but is constrained to say that this particular infringement is relatively low-level on the scale of egregiousness. Because of the wide variation among the defendants and the large number remaining (around 60) the Court is highly disinclined to do a defendant-by-defendant assessment and thus has reduced the damage award for all defendants to what the Court considers to be the least common denominator.
